RingPlus is a free-spirited telephone and social network community in which all members interact in an environment of trust, honesty, and respect. RingPlus’ ultimate goal is to provide unlimited free-calling to its members through advertisement revenue generated over its social network.

Terms and Conditions

We ask all members to adhere to the following terms and policies, as well as to report any illegal or unethical behavior or any infringement of copyrighted content posted on our social network immediately to us at ethics@ringplus.net to enable us to take the appropriate actions. RingPlus (“RingPlus”) & Mixcess and its affiliates follow the strictest ethical guidelines. We keep your information private, and will share information only as required by law and in conducting normal business activities. We will not share or sell your information to third parties, and we safeguard our network from intrusion by third parties.

By using RingPlus Services (including without limitation, its websites, phones, and phone services) you signify your agreement to RingPlus’ Terms and Conditions which include (without limitation) RingPlus’ (1) Rules, (2) General Terms of Service, (3) Privacy Policy, (4) Community Guidelines (found at www.ringplus.net), and (5) Legal Notices (collectively the “Terms”). If you do not agree to any of these Terms you may not use RingPlus’ Services. The Terms are subject to change at any time by RingPlus without notice.

General Rules

RingPlus may, in its sole discretion and without notice, expire, suspend, terminate or downgrade your Service if you do not comply the General Rules listed here as well as any additional rules (including without limitation the "Rules of the Road") which may specifically apply to the plan attached to your account.

  1. Do not use the phone for any activity that is illegal and prohibited by law.
  2. Do not harass other members with marketing and other inappropriate phone calls.
  3. You cannot resell activated phones to other users for financial gain.
  4. You cannot engage in any other behavior deemed inappropriate for the health of the program.
  5. To sign up for a RingPlus account, you must be at least 18 (eighteen) years old and have a valid credit card on file (unless otherwise stated.)
  6. You may not use your account for any commercial purpose.
  7. You may not activate a unauthorized phone. You can verify your phone model using the BYOSD Phone Check tool.
  8. RingPlus reserves the right to refuse service at any time, to anyone, for any reason.
  9. Billings, Payments, Refunds, Transfers, Cancellations, and Reactivations:
  10. a. All plans on RingPlus are pre-paid and auto-renew every month.
    b. Monthly payments will be automatically charged to your credit card, or drawn from your top up balance, depending on your plan.
    c. All sales are final.
    d. RingPlus will not issue any refunds or allow any transfers of funds, including any portion of unused funds on an account, except in RingPlus’ sole discretion.
    e. Caution: If for any reason you fail to pay for your service on or before the due date, your service will be terminated and you phone number will be placed in suspend mode.
    f. Caution: If you cancel your account without first porting your phone number out, or your account is terminated for any reason, you will lose your phone number. Please contact RingPlus support before cancelling.
    g. If your Paid Plan is suspended for nonpayment for 60 days or less, you can reactivate it for a fee of $3.99, and accounts suspended for more than 60 days may be expired.
  11. If you do not make calls using your Free Plan for 60 days, RingPlus may, in its sole discretion and without notice, expire, suspend, terminate or downgrade your Service.
  12. Please note that you may not deactivate and reactivate your account in the same billing cycle.
  13. You cannot have more than 10 devices on your account.
  14. You cannot use talk, text and data plans as data-only plans or any other similar use including, without limitation, GPS navigation or continuous media streaming.
  15. Data-only devices including, without limitation, tablets and hotspots cannot be used on talk, text and data plans. Data-only devices can only be used on data-only plans.
  16. Tethering or hot-spotting are not allowed unless your plan has a tethering Add On which was either included by RingPlus or purchased by you from RingPlus.
  17. You cannot do (or try to do) the following to the RingPlus systems: game the systems, hack the systems, harm the systems, or use the systems in any unreasonable manner as determined by RingPlus in its sole discretion (including, without limitation, constant streaming of movies and continuous game play).
  18. Data speeds and other services are not guaranteed. Coverage is on the Sprint Nationwide Network, and may not be available in some areas. Service and data speeds may vary depending on your location and device.
  19. Data usage cannot always be processed right away or accurately time stamped due to our carrier partners' limitations, but the usage will still count towards your allotment for the month in which you used the data (including overages).
  20. RingPlus may in its sole discretion meter and bill data in kB, MB, GB or increments thereof, and round up as RingPlus determines is best for the RingPlus community as a whole, depending on the type of data used, and the terms of the plan you are on. Talk is metered and billed in minutes, and rounded up to the next whole minute. SMS and MMS are metered and billed on a per unit basis.
  21. This rule does not apply to plans featuring set allotments of data (e.g. 3GB), or any plan or Add On (i.e., an allotment of minutes, SMS, MMS or data offered separately from a plan) first offered on or before 9/13/16. This rule applies to plans featuring unlimited minutes, unlimited SMS, unlimited MMS and unlimited data, and Add Ons offered after 9/13/16 in order to prevent Abuse and to protect the RingPlus community as a whole. “Abuse” includes failure to abide by RingPlus Legal Notices, the terms of your plan, fraud, attempted fraud, defrauding RingPlus, attempting to defraud RingPlus, or engaging in (or attempting to engage in) conduct which financially, technologically or legally harms RingPlus. If your use of minutes, SMS, MMS or data in any current billing cycle exceeds your use of minutes, SMS, MMS or data (i.e., a comparison of like units such as SMS, etc.) for any prior billing cycle in the immediately prior 6 months by more than 50%, RingPlus may examine your usage of your plan as such deviations in usage patterns may indicate that there may be an issue that needs to be investigated by RingPlus. If RingPlus does not find Abuse, RingPlus will take no action. If RingPlus finds Abuse, it may in its discretion and with notice suspend, downgrade, or terminate your Service. You may appeal such decisions to the Ethical Committee in the RingPlus Social forum at https://social.ringplus.net, and RingPlus will respect the ruling of the Ethical Committee. In cases involving termination of accounts, you will be given seven (7) days to initiate a port-out to preserve your phone number (we understand it may take more time to actually complete). RingPlus had added this rule in order to be open with you to make you aware that we will monitor the system for Abuse of such plans in order to protect the community.
  22. If more than 50% of your talk, text or data occurs while roaming, RingPlus may in its sole discretion and without notice, expire, suspend, terminate or downgrade your Service.
  23. This rule does not apply to plans featuring set allotments of data (e.g. 3GB), or any plan or Add On (i.e., an allotment of minutes, SMS, MMS or data offered separately from a plan) first offered on or before 9/13/16. This rule applies to plans featuring unlimited minutes, unlimited SMS, unlimited MMS and unlimited data, and Add Ons offered after 9/13/16 in order to prevent Abuse (defined in General Rule 20, above) and to protect the RingPlus community as a whole. If your use of minutes, SMS, MMS or data in any current billing cycle exceeds the average use of minutes, SMS, MMS or data (i.e., a comparison of like units such as SMS, etc.) by all RingPlus Members on the same plan by more than 50%, RingPlus may examine your usage of your plan as such deviations in usage patterns may indicate that there may be an issue that needs to be investigated by RingPlus. If RingPlus does not find Abuse, RingPlus will take no action. If RingPlus finds Abuse, it may in its discretion and with notice suspend, downgrade, or terminate your Service. You may appeal such decisions to the Ethical Committee in the RingPlus Social forum at https://social.ringplus.net, and RingPlus will respect the ruling of the Ethical Committee.   24. You agree not to initiate any chargeback without first trying to resolve your issue with RingPlus support staff as chargebacks harm the community as a whole.
  25. You agree to resolve any dispute with us through binding arbitration administered by JAMS according to the JAMS Comprehensive Arbitration Rules & Procedures or small claims dispute procedures in Los Angeles, CA and California law will apply. You agree to waive your rights to a class action suit and jury trial.

Magic Program Terms

addition to all other RingPlus terms, the following terms shall apply to Magic Programs which include, without limitation, Matching Magic and Magic Friend. Magic Programs generate benefits such as quantities of minutes, SMS, and data (herein called “Magic Rewards”) to eligible RingPlus accounts on the terms set forth below.

  1. Matching Magic Phone Plan.
  2. a. Matching Magic plans are available exclusively to current Ring Plus members who have two or more active paid phone plans (herein called “RingPlus Phones”) in their account.
    b. Matching Magic plans accumulate quantities of Magic Rewards (i.e. talk, text, and data) from a member’s usage of the other RingPlus Phones in the member’s account.
    c. RingPlus members with a Matching Magic phone plan who have used all available Magic Rewards in their plan may purchase additional amounts of minutes, SMS, and data at the then current Magic Program overages rates.
    d. RingPlus members must place a valid credit card on file in order to access paid services.
  3. Magic Friend Referral Program.
  4. a. The Magic Friend referral program shall apply exclusively to new RingPlus members who sign up as a result of a referral from an existing RingPlus member.
    b. A new RingPlus member (herein called a “Magic Friend”) can give Magic Rewards to the individual who referred them. Such Magic Rewards accumulate from a Magic Friend's usage of their plan.
    c. A Magic Friend can only give Magic Rewards to one RingPlus member. However, RingPlus members can receive Magic Rewards from multiple Magic Friends by referring multiple individuals to RingPlus.
    d. RingPlus members cannot refer themselves to get Magic Rewards of any kind. (They can, however, create their own Matching Magic phone plan which can receive Magic Rewards from Magic Friends.)
    The Magic Rewards generated by Magic Friends are permanently linked to the person who referred them. Once the Magic Friend has identified the RingPlus member who referred them, the Magic Friend cannot later give the Magic Rewards to another RingPlus member.
  5. General Magic Program Terms
  6. a. Eligibility for participation in each Magic Program shall be set forth in the sections containing the specific terms unique to each program.
    b. Magic Rewards shall not include MMS or any roaming usage or services.
    c. Magic Rewards shall be applied to eligible accounts no sooner than 24 hours after the particular Magic Reward(s) is generated.
    d. Magic Rewards must be used within 24 hours of being applied to an eligible account. All amounts of Magic Rewards not used within that time shall expire and be forfeit without compensation of any kind.
    e. Magic Rewards cannot be redeemed or exchanged for credit, cash, or any other form of compensation.
    f. All Magic Programs, their terms, and any RingPlus member’s participation in them, are subject to change or termination by RingPlus in its sole discretion at any time for any or no reason without any liability to RingPlus.
    g. The quantity and ratio of Magic Rewards generated in a Magic Program shall be determined, and may be changed, by RingPlus in its sole discretion at any time for any or no reason without any liability to RingPlus.
    h. Magic Rewards cannot generate Magic Rewards. A RingPlus member who receives Magic Rewards from a Magic Friend referral cannot receive any benefit from the referred member’s usage of any Magic Rewards. However, a RingPlus member who has a Matching Magic phone plan can receive Magic Rewards from a Magic Friend referral.
    i. RingPlus reserves the right to void any Magic Rewards of any participant if it suspects that the participant is not eligible, has acted in any fraudulent manner, or has violated any of these terms (or any other RingPlus terms).
    j. Any gaming or other abuse of the Magic Programs is expressly forbidden. Violators may be subject to permanent ban from RingPlus as well as civil and criminal prosecution. In addition, users of auto-dialers shall be detected and shall be charged, and hereby agree to pay, ten cents per unit for all past usage, and their account shall be terminated.
    k. All participants in any of the Magic Programs agree not to use the Magic Program for any commercial purpose, use the Magic Program for any unlawful purpose, or resell any aspect of the Magic Program including (without limitation) Magic Rewards.
    l. In no event shall RingPlus have any liability to any party for any kind of damages or claims arising out of or in any way related to participation in any Magic Program.
    m. These terms shall control in the event of any conflict with any other RingPlus terms.

General Term of Services

Thanks for choosing RingPlus. In these General Terms of Service (“General Terms”), you'll find important information about your Terms and Services (as defined below), including our ability to make changes to your Service and/or Terms and Conditions, our and your liability if things don't work as planned, and how any disputes between us must be resolved in arbitration or small claims court.

RingPlus is first and foremost a social network service for entertainment purposes. These General Terms apply to the mobile phones and devices RingPlus sells, the services we offer to our Members, and the RingPlus Service Plans including the rates, features and other terms for the minutes, messages and/or data that you purchase as well as mixcess or any RingPlus products, software, data feeds, and services provided to you on, from, or through ring back tone, mixcess, application, telephone call, text, mobile services, mobile website (collectively the "Service").

The Terms and Conditions become effective when you accept them by doing any of the following: (1) purchasing or activating a RingPlus plan, phone or device; (2) telling us orally that you accept; or (3) using your RingPlus phone or device after you make a change to your account. If you do not want to accept the Terms and Conditions, do not do any of these things and contact RingPlus at (310) 919-0915. When you accept the Terms and Conditions, you represent that you are at least 18 years of age. You may not assign your rights or delegate any of your duties under the Terms and Conditions without our prior written consent, and any attempted assignment or delegation without such consent is void. We may assign all or part of the Terms and Conditions or your debts to us without notice.

We provide mobile telecommunications Service using the Nationwide Sprint® Network for use exclusively with RingPlus phones and devices purchased from us or an authorized retailer. You cannot use our Service with any other brand of mobile phone or device or on any other network, and you may not use RingPlus phones or devices with any other service or network. Airtime may be used for domestic calling in the United States and for other services as provided in the Terms and Conditions. For international calls, an additional international calling fee will be added according to the country which you are calling. Our service plans may change at anytime at our sole discretion and without notice. In addition to mobile services we will provide you with a social network “mixcess.” The usage of this social network will be at your own risk. You hereby agree to indemnify RingPlus from any liability resulting from your exposure to content derived from the social network, as well as the uploading of content to the social network by you or third parties. These Terms and Conditions apply to all users of the Service, including users who are also contributors of Content (as defined below) on the Service. “Content” includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through, or contribute to the Service. The Service includes all aspects of RingPlus, including but not limited to all products, software and services offered via the RingPlus network, application and website.

The Service may contain links to third party websites that are not owned or controlled by RingPlus We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, RingPlus will not and cannot censor or edit the content of any third-party. By using the Service, you expressly relieve RingPlus from any and all liability arising from your use of any third-party website and/or content.

In order to access some features of the Service, you will have to create a RingPlus account. You may never use another party’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify RingPlus immediately of any breach of security or unauthorized use of your account.

RingPlus will not be liable for your losses caused by any unauthorized use of your account.

Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service and as permitted under these Terms and Conditions. You shall not download any Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent the respective licensors of the Content. RingPlus and its licensors reserve all rights not expressly granted in and to the Service and the Content.agree not to circumvent, disable or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Service or the Content therein.

You understand that when using the Service, you will be exposed to Content from a variety of sources, and that RingPlus is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content. You further understand and acknowledge that you may be exposed to Content that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against RingPlus with respect thereto, and, to the extent permitted by applicable law, agree to indemnify and hold harmless RingPlus, its owners, operators, affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related to your use of the Service.

As a RingPlus account holder you may submit Content to the Service, including videos and user comments. You understand that RingPlus does not guarantee any confidentiality with respect to any Content you submit.

You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to RingPlus all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms and Conditions.

For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to RingPlus, you hereby grant RingPlus a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and RingPlus' (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms and Conditions. The above licenses granted by you in video Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your videos from the Service. You understand and agree, however, that RingPlus may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.

You further agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant RingPlus all of the license rights granted herein.

You further agree that you will not submit to the Service any Content or other material that is contrary to the RingPlus Community Guidelines, currently found at www.ringplus.net, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.

RingPlus does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and RingPlus expressly disclaims any and all liability in connection with Content. RingPlus does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and RingPlus will remove all Content if properly notified that such Content infringes on another's intellectual property rights. RingPlus reserves the right to remove Content without prior notice.social network service, as well as telecom service and other services, is for personal domestic use only. International calls will incur a higher additional charge per minute. (See list of international termination charges). We have determined that placing abnormally high numbers of calls, sending or receiving unusually high numbers of messages, or repeatedly placing calls of unusually long duration relative to typical usage by other Members on similar service plans suggests that a mobile phone or device is being used other than for personal use in violation of the Terms and Conditions.

Voice services are provided solely for live dialogue between two individuals and may not be used for monitoring services, data transmissions, or other connections that do not consist of uninterrupted live dialogue between two individuals. Our mobile phones and mobile phone numbers may not be used for pager or voicemail-only service, and we may terminate any account primarily used for pager service or voicemail retrieval service. Our mobile phones and devices may not be purchased in bulk or sold to third parties.

You agree not to use our services in any way that is illegal, fraudulent, threatening or abusive, as we may determine in our sole discretion. You may not alter any of the hardware or software on your mobile phone for any purpose. We may change your mobile phone’s software, applications or programming remotely and without notice. This may affect stored data or other personal information or programming on your mobile phone for which we are not responsible.

The software and content on our mobile phones and devices, including the operating system, applications, data, information, music, games, images, text and other material, are owned by us or our business partners. You are permitted to use this software and content solely in connection with your use of your RingPlus phone or device with our service as expressly authorized under the Terms and Conditions. You may not distribute or upload any pre-loaded software or content to another mobile phone or device, or transmit or broadcast the software or content, or otherwise copy or use the software or content in any manner not expressly authorized under the Terms and Conditions. If you violate the Terms and Conditions, including without limitation by using one of our mobile phones or devices on another network without our prior written consent, by modifying any hardware or software on our mobile phones or devices, or by distributing, copying or otherwise using any of the software or content on one of our mobile phones or devices in a manner that is not authorized by the Terms and Conditions, your license to the software and content will terminate immediately and your continued use will constitute copyright infringement.

Our service is currently only available in certain geographic areas covered by the digital service network footprint of the Nationwide Sprint Network, reaching over 276 million people. Local phone numbers may not be available in certain markets.

Wireless services use radio transmissions and coverage is not available everywhere. Quality of service may be affected by conditions within and beyond our control, including atmospheric, geographic, or topographic conditions, or by damage to your mobile phone or device. We do not warrant or guarantee that service will be available at any specific time or geographic location, or that service will be provided without interruption. Any statements or maps provided by us, our agents or dealers about coverage are intended to provide high-level estimates of our coverage areas when using our service outdoors under optimal conditions and do not mean that service will be available under all circumstances, at all times or without interruption. Estimating wireless coverage and signal strength is not an exact science. There are gaps in coverage within our estimated coverage areas that, along with other factors both within and beyond our control, may result in service interruptions, slower data speeds, or lower quality of service. You should therefore never solely rely on your mobile phone for emergency calls, including to 911.

RingPlus wireless services are provided on the Nationwide Sprint Network, RingPlus is responsible to Alpha subscribers for their services. Please call RingPlus with any questions or comments about services.

Website and Service Use

RingPlus hereby grants you a limited, revocable, nonexclusive license to use its website (“Site”) and Services solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy materials on the Site and/or Service, reverse engineer or break into the Site and/or Service, or use materials, products, or services in violation of any law. Your use of this Site and Service is at the discretion of RingPlus.

Intellectual Property

All content included on this Site is and shall continue to be the property of RingPlus or its licensors and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use, or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement or a separate writing signed by RingPlus. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site. RingPlus consents to you browsing this Site or storing the Site pages on your computer, or printing of the Site pages, for your personal, non-commercial, and informational use only, unless otherwise consented to by RingPlus in writing. This limited consent shall terminate automatically if you breach any of these Terms and Conditions of Use. Upon such termination, you shall immediately destroy all Site content in your possession. Sprint is a trademark of Sprint.

Our Right to Make Changes

Our service is provided at our discretion. We may change our Terms and Conditions, including our plans and pricing, from time to time. Unless expressly prohibited by law, we reserve the right to modify or cancel our service or your account or take corrective action at any time and for any reason, including, but not limited to, your violation of any provision of the Terms and Conditions.

Switching between Service Plans

Unless otherwise provided in these Terms and Conditions, you may switch current service plans. When you switch service plans, you will not receive a refund of any portion of any previously paid service charges. A $6 fee may be levied upon your account to cover activation/deactivation costs.

Account History

Your account history is only available online. If you deactivate your service or change your mobile phone number, you may obtain your account history by contacting RingPlus at (310) 919-0915.

Taxes and Surcharges

Stated prices for our services do not include certain taxes or surcharges. We charge state and local sales taxes on some purchases made through our website at www.ringplus.net. Charges may also include a surcharge for federal and state Universal Service Fund contributions and state and local 911 fees, as well as a cost recovery surcharge. The amount of these surcharges is subject to change and may vary from time to time and by geographic area. Surcharges are assessed to help defray our costs incurred in complying with federal and state telecommunications regulations. Surcharges are not taxes or fees that the government requires from consumers. Taxes, fees and surcharges are subject to change without notice.

BYOSD (“Bring Your Own Sprint Device”) Program Feature Availability Disclaimer

Not all devices branded with the Sprint trademark are eligible for activation by RingPlus under the BYOSD Program; please contact your RingPlus representative to determine eligibility. Specific restrictions and exclusions apply. Some features of the device may not function properly when activated with RingPlus. Please ask your RingPlus representative about any limitations.

Bring Your Own Sprint Device Terms and Conditions

Because your Sprint device is no longer active on a Sprint retail account, many of the device features will no longer work and RingPlus, who is responsible for your service, cannot support them. These include, but are not limited to: Sprint Zone, Sprint Family Locator, TeleNav GPS, Sprint Radio, Sprint Music, Sprint TV, Sprint Mobile Sync, Sprint Powerdeck, Sprint My Account, Sprint Mobile Wallet. In addition, these features may not work: Picture Mail, Multimedia Services.

Messaging

Please be aware that standard messaging rates may apply for the recipient of your message(s). RingPlus is not liable for charges imposed by the recipient’s wireless carrier. Your unlimited messaging plan is for incoming and outgoing messages on your RingPlus device and does not extend to your recipient.

Charges

General

Charges are deducted from your credit card or debit card. If you have incurred charges or fees that were not charged prior to your account balance reaching zero, we may deduct these outstanding unpaid charges and fees at a later time.

Additional Charges

We will charge you fees for each call to directory assistance plus airtime charges for minutes used.fees are listed online at www.ringplus.net for your convenience. Please be aware that fees are subject to change at any time, without notice.

Disputed Charges

If you think that there has been an error in any charge to your account, you must notify us promptly within 30 days after the charge appears on your account. Email us at ethics@ringplus.net and one of our advisors will investigate your claim. If you do not promptly notify us, you waive any right to dispute the charge, including in arbitration or a court proceeding. If we determine that the disputed charge was inappropriate and was raised by you in a timely manner, we will issue a credit or refund in our sole discretion. We are not liable for any charges for products or services provided by third parties through and for use on our mobile phones, devices and network. If an unauthorized or disputed charge for a third-party product or service appears in your account history, you must contact that third party directly.

Account Suspension Related to Credit Card Chargebacks

If we have attempted to charge your registered payment method for a charge that we deem is authorized and valid under the Terms and Conditions, and the credit/debit card company withholds such payment because the charge has been disputed (a “Chargeback”), we reserve the right to suspend your access to our service for up to 30 days until the Chargeback is reversed. If the Chargeback is not resolved and reversed, your account will be deactivated at the end of the 30-day period and we will assess you a termination charge equal to the prorated balance of your account, which is not refundable. If your account is reactivated, you may be charged a fee for each Chargeback.

Payments, Refunds, Transfers, and Cancellations

  • Monthly payments will be automatically charged to your credit card.
  • All sales are final.
  • RingPlus will not issue any refunds in any amount for any reason, including any portion of unused funds on an account, except in RingPlus’ sole discretion.
  • RingPlus will not allow any transfers of any portion of unused funds on an account.
  • If you switch service plans, you will not receive a refund of any portion of any previously paid and/or unused service charges, and $6 fee may be levied upon your account to cover activation/deactivation costs.
  • Caution: If you cancel your account without first porting your phone number out, or your account is terminated for any reason, you will lose your phone number. Please contact RingPlus support before cancelling.

Lost or Stolen Equipment

If your mobile phone or device is lost or stolen, you are responsible for charges incurred until you notify us of the loss of your mobile phone or device by visiting our website at www.ringplus.net. Upon receiving notice that your mobile phone or device is lost or stolen, we will suspend your account. If you do not either activate a new mobile phone or device, or notify us that you have found your old mobile phone or device within 25 days of the suspension of your account, your account will be deactivated, we will assess you a termination charge equal to the balance in your account, which is not refundable, and, if applicable, you will lose your phone number.

Mobile Phone Number

The mobile phone number we provide for your use is and will remain our property. If you cancel your service or your account is deactivated, we may give the mobile phone number to another Member without notice (unless you transfer the mobile phone number to another telecommunications provider in accordance with applicable regulations). We may also change your mobile phone number at any time, although we will notify you prior to any change.

Keeping Your Old Phone Number

Depending on where you live, you may transfer an existing wireless or wireline carrier telephone number to our service for use as your mobile phone number. To switch an existing phone number to us, contact RingPlus at (310) 919-0915 or email membersupport@ringplus.net . Before you call, please have a bill from your existing wireless or wireline carrier available. When you switch from another wireless carrier to RingPlus, you may have to pay a termination penalty to your former carrier if you terminate your contract early. We will not reimburse you for any fees imposed by other carriers.

Please note that if you cancel your account you may lose your number. Contact RingPlus support before canceling your account for more information.

Specific Terms and Restrictions regarding Data Services

If your plan includes data services, such services are provided solely for purposes of web browsing, messaging, and similar ac (1) with “auto-responders”, “cancel-bots”, or similar automated or manual routines which generate excessive amounts of traffic, or which disrupt user groups or email use by others; (2) to send “spam” or unsolicited commercial or bulk email (or activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email); or (3) for any activity that adversely affects the ability of other people or systems to use either our wireless services or other parties’ Internet-based resources. We reserve the right to limit, suspend or terminate without notice any Member’s account for misuse of our network or violation of these Terms and Conditions.

Data services allow you to access the Internet to view, download and send text, pictures, games, graphics, music, email, sound and other materials (“Content”). Some Content is available from us or our business partners, while other Content can be accessed from other third-party websites or services. Content may be unsuitable for children or minors, unreliable, inaccurate, offensive, indecent or objectionable. You are solely responsible for evaluating the Content that you or anyone using your mobile phone or device access. We strongly recommend that you monitor Content access by children or minors. Prior to accessing certain Content, we may require you to provide some personal information to verify that you are at least 18 years of age. Content from third parties may also harm your mobile phone, device or its software. We may place restrictions on accessing certain Content, impose separate charges, limit the amount of data you can access or transfer, or otherwise limit or terminate services.

We do not endorse the Content, features, or software offered by third parties. Your relationship with providers of Content is between you and them. WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING ANY CONTENT OFFERED BY A THIRD PARTY THAT YOU MAY UTILIZE OR OTHERWISE ACCESS WHILE USING YOUR MOBILE PHONE OR DEVICE, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, NON-INFRINGEMENT, PERFORMANCE OR ACCURACY. We have no control over the Content on any website that you may access via your mobile phone or device. We strongly recommend that you use good judgment and care in sharing any personal information about yourself. The Content provided by us and our business partners is for your private, non-commercial use only. You may not sell or resell Content. You may not upload and transmit or broadcast Content in public places. You will be solely responsible if you engage in any unauthorized use of Content.

In the event that you lose access to Content you have purchased, regardless of the reason for such loss, including without limitation the failure of your mobile phone, device or computer, we may not make such Content available to you free of charge.

Our rights to license to you certain of the Content may expire or may be changed at any time and without notice. We will not extend your rights to such Content, and will not provide any reimbursement of any fees or other amounts paid to us for Content. You may contact us to request replacement Content, but we will not be required to provide any such replacement Content.

Acceptable Use of Our Products and Services

You may not use your RingPlus phone or device, or our service, for any illegal purpose, including to harass, threaten, abuse, defame or slander any individual or entity. You may not use our service in a manner that interferes with another Member’s use of our service.

Objectionable or Offensive Content

You may not publish, copy, reproduce, upload, download, post, distribute, edit, modify, or otherwise transmit (“Post”) any Content that is unlawful, libelous, defamatory, slanderous, obscene, pornographic, harassing, threatening, abusive, harmful, copyrighted or otherwise objectionable, or that infringes upon or otherwise violates others’ rights, including privacy rights.

Unlawful Content

You may not Post any Content that encourages or is in furtherance of an unlawful, criminal, or fraudulent activity or that violates any of our rules or policies.

Soliciting Information

You may not Post any Content that solicits any information from other Members or involves any commercial activities, including advertisements.

Infringing Content

You may not Post any Content that may infringe on or otherwise violate any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any person. Infringement may result from the unauthorized copying, posting, editing, modifying or distributing of any Content, including but not limited to ringtones, graphics, pictures, photographs, logos, software, articles, music, games, or videos. By Posting any Content, you represent that you have legal rights to use, distribute and publish such Content.

Harmful Content

You agree not to Post any Content that contains viruses, worms, time bombs or other similar programs.

Removal of Content

We reserve the right, in our sole discretion, to remove or delete any Content that you Post on our service that violates the Terms and Conditions or is otherwise deemed objectionable by us in our sole discretion. We may delete Content that you have downloaded or limit the amount of Content that you may download during any given period.

Suspension or Termination of Service

We reserve the right to issue a warning and to suspend or terminate your service and access to the www.ringplus.net website or any other website we operate or to our service at any time if we determine in our sole discretion that you have violated the Terms and Conditions or any of our rules or policies or for any other reason in our sole discretion.

Storage of Content

Some Content may not be stored or processed because of memory limitations. You agree that we are not liable for the deletion of or failure to store Content, and, in compliance with the Terms and Conditions, you should store photographs and other information permanently by using another means, such as a CD-R or personal computer. Content may expire within 60 days of its original download unless you otherwise request its retention and/or preservation. A password may be required to use or access Content. The ability to make use of certain downloadable Content requires the use of a compatible mobile phone and is subject to certain functionality limitations such as memory, processor speed, and graphics capability. We will disclose to third parties any Content necessary to respond to claims that such Content violates the rights of third parties.

Unsolicited Messages

If you intentionally send spam from your RingPlus phone, we may terminate your service without further notice. If we terminate your service, your account will be deactivated, you will lose your mobile phone number, and we will assess you a termination charge equal to the prorated balance in your account, which is not refundable.

Use of Applications

Not all applications will work on all of our mobile phones, and some applications may not be available in all areas. Use of certain applications may require the disclosure of personal information subject to the policies of the companies that offer such applications.

Location-Based Services

Location-based services use and provide information based on the location of your mobile phone. When you turn on your mobile phone, it automatically communicates with our network and relays its current location unless you have turned off your mobile phone’s location functionality. The accuracy of location-based services may be affected by circumstances beyond our control, including atmospheric, geographic or topographic conditions. We do not warrant or guarantee that location-based services will be available at any specific time or geographic location, or that service will be provided without interruption.using our location-based services, you consent to have us or our business partners electronically collect, monitor and track your physical location and the location of your mobile phone. We collect and disclose your location information only to provide you with the location-based services you have requested, or in emergency situations as prescribed by law. If you allow others to use your mobile phone, you are responsible for informing these users that their location information may be collected or disclosed. We will not provide your location information to third parties without your consent other than as prescribed by law.

Pay-Per-Call Services

We may not directly complete any calls to 1-900, 1-976 or other pay-per-call services. If such services are connected you will be charged an additional charger equal to our cost.

International Calling and Roaming

We will directly complete any calls but not send text messages to international numbers. Your wireless plan is to be used for USA based phone numbers only. Your wireless plan does not include domestic or international roaming; your device will not work outside the RingPlus calling area.

You're "roaming" whenever your wireless device uses a transmission site outside your Coverage Area or uses another company's transmission site. Sometimes roaming happens even when you're within your Coverage Area. There may be higher rates and extra charges (including charges for long distance, tolls or calls that don't connect) for roaming calls.

Safety and Security

We are not responsible for the content or security of voicemail, messages or contact lists you create.

Use your mobile phone and device in a safe manner that does not create a risk to your safety or the safety of others around you. While driving, always use a hands-free device and never use your mobile phone to send text messages. Always use your mobile phone and device in accordance with all applicable laws and regulations.

Use of Your Member Information

When you agree to the Terms and Conditions, you also agree to the terms of our Privacy Policy (available at www.ringplus.net). This policy may change from time to time and includes important information on what data we collect about you, how we use this data and with whom we share that data.

In the course of providing service to you, we may collect certain information made available to us solely because of our relationship with you, including information regarding the nature and type of your service and the calls that you place and receive.

To comply with appropriate legal process, we may disclose to law enforcement authorities and governmental agencies any information, including your name, account history, account information or other transmission data properly requested by law enforcement.

Mobile Website

You may use our website located at www.ringplus.net to manage your account, make payments, view our content and learn more about our products and services. Use of the our website is subject to the terms set forth in the Terms of Website Use and Privacy Policy, which are available on our website.

Dispute Resolution

We each agree to contact each other first with any disputes. You must contact us with any dispute by email at ethics@ringplus.net. We will contact you at the last address that you have provided us or on your mobile phone. We each agree to negotiate in good faith to resolve any dispute.

No Trial by Jury

If a claim proceeds in court, we each waive any right that we may have to trial by jury in any lawsuit or other proceeding to the extent permitted by law.

Limitation of Liability

We and you agree to limit claims for damages or other monetary relief against each other to direct and actual damages unless prohibited by law. You agree that we and our business partners are not liable to you or any third party for any indirect, special, incidental, consequential, exemplary or punitive damages of any kind, including lost profits (regardless of whether we have been notified that such loss may occur) by reason of any act or omission in our provision of products or services or under any legal theory, including fraud, misrepresentation, breach of contract, personal injury, product liability or any other theory. We assume no risk or responsibility for your use of anyContent. We are not liable for (1) any act or omission of any other company furnishing a part of our Service or any equipment provided for such service; (2) errors or omissions of our business partners; (3) any damages that result from any product or service provided by or manufactured by third parties; or (4) any unauthorized or disputed charges for our Service that appeared more than 30 days earlier on your online account statement which you did not promptly dispute in accordance with the Terms and Conditions. You acknowledge that no fiduciary or other special relationship exists between you and us, by virtue of the Terms and Conditions or your use of our mobile phones and services. You also agree we are not liable for missed voicemails or deletion of contacts from your address book, Content, or lost messages from your voicemail system as well as any content related to the mixcess social network.

Warranties

We do not manufacture our mobile phones or other equipment. The only warranties applicable to our mobile phones or other equipment are those extended by the manufacturers. We have no liability, therefore, in connection with mobile phones and other equipment or for manufacturers’ acts or omissions.MAKE NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND SERVICES PROVIDED HEREUNDER OR ANY SOFTWARE USED IN CONNECTION THEREWITH, INCLUDING, BUT NOT LIMITED TO, AND TO THE EXTENT PERMITTED BY LAW, WARRANTY OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, QUALITY, NON-INFRINGEMENT, PERFORMANCE OR ACCURACY. We expressly disclaim any and all implied warranties. WE DO NOT PROMISE ERROR-FREE OR UNINTERRUPTED SERVICE AND DO NOT AUTHORIZE ANYONE TO MAKE WARRANTIES ON OUR BEHALF.

Indemnification

You agree to indemnify and hold harmless us and our affiliates and their respective officers, agents, partners and employees, from any and all liabilities, settlements, penalties, claims, causes of action and demands brought by third parties (including any costs, expenses or attorneys’ fees on account thereof) resulting from your use of our products and services, or use of our products and services by another person who uses your mobile phone and/or our products or services, whether based in contract or tort (including strict liability) and regardless of the form of action.

Severability

If any provision of these Terms and Conditions is held to be illegal, invalid, or unenforceable under present or future laws by any court of competent jurisdiction, such illegality, invalidity, or unenforceability shall not affect the legality, validity, or enforceability of any other provisions or of the same provision as applied to any other fact or circumstance, and such illegal, invalid, or unenforceable provision shall be modified at RingPlus’ sole discretion to the minimum extent necessary to make such provision legal, valid, or enforceable, as the case may be.

Effect of Terms and Conditions

The Terms and Conditions supersede all oral or written communications and understandings between you and us with respect to our products and services and the terms under which they are offered and provided to you. If any part of the Terms and Conditions is declared invalid or unenforceable, all other parts of the Terms and Conditions are still valid and enforceable. Such invalidity or non-enforceability will not invalidate or render unenforceable any other portion of the Terms and Conditions. No provision of the Terms and Conditions provides any person or entity not a party to the Terms and Conditions with any remedy, claim, liability, reimbursement, or cause of action, or creates any other third-party beneficiary rights.

Unless otherwise specified herein, any disputes of a legal nature, whether a claim, complaint, arbitration demand or otherwise, shall be subject to the exclusive jurisdiction of the federal, state, or Los Angeles Superior Courts located in Los Angeles, CA.

Notices will be considered effective upon receipt. If you are unable to resolve your concerns with us, you may file a complaint with the Federal Communications Commission, 445 12th St., SW, Washington, DC 20554. Any notice we send you will be sent to your last known residence or electronic address as shown on our records, or via text message to your RingPlus phone.

Export

You agree to comply with all trade regulations and export control laws, both domestic and foreign. Our mobile phones, equipment, software, and any underlying information accessed or transferred by you using our services may be subject to U.S. export controls, including the Export Administration Act (50 U.S.C. § 2401, et seq.) and the Export Administration Regulations (50 C.F.R. § 730-774), as well as the import regulations of other countries. You agree not to export or re-export any our mobile phones, equipment, or software to any foreign country. Any information transferred by you using our services to any foreign country, entity, or person must comply with the U.S. Export Administration Act and the Export Administration Regulations.

Digital Millennium Copyright Act

If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

RingPlus' designated Copyright Agent for DMCA notices is Jerry Mowery. Any other legal feedback, comments, and other communications regarding notifications of claimed infringement should be directed to ethics@ringplus.net. You acknowledge that if you fail to comply with all of the requirements of this Section 5(D), your DMCA notice may not be valid.

Counter-Notice. If you believe that your Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your Content, you may send a counter-notice containing the following information to the Copyright Agent:

Your physical or electronic signature;

Identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled;

A statement that you have a good faith belief that the Content was removed or disabled as a result of mistake or a misidentification of the Content; andname, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in Los Angeles, California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, RingPlus may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed Content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Content provider, member or user, the removed Content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at RingPlus' sole discretion.

RingPlus is a free-spirited telephone and social network community in which all members interact in an environment of trust, honesty, and respect. To activate and manage your account and obtain access to certain services, we require you to provide a secret code (your “Account PIN”). When using your account or providing your Account PIN, you must provide accurate and complete information to RingPlus You are entirely responsible for maintaining the confidentiality of your Account PIN and are solely responsible for any activity conducted using your Account PIN. You agree not to use the account, Member name, or Account PIN of another Member at any time unless that Member is under 18 and you are the parent or guardian of that Member.

We may periodically conduct surveys of our Members and/or users of our websites (“survey participants”). We encourage you to participate in these voluntary surveys because they provide us with important information that helps us to improve the types of services we offer and how we provide them to you. Your personal information and responses will remain confidential, even if the survey is conducted by a third-party.

We take the information we receive from individuals responding to our surveys and combine (or aggregate) it with the responses of other survey participants to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We may use third party service providers to facilitate our services, and therefore, we may provide some of your Personally Identifiable Information directly to them. In addition, we employ other companies and individuals to perform functions on our behalf. Some examples include fulfilling orders, providing mobile content, delivering packages, sending postal mail and email, removing repetitive information from Member lists, analyzing data, providing marketing assistance, processing credit card payments and providing Member service. These service providers have access to Personally Identifiable Information and may use it as needed to perform their functions, but may not use it for any other purpose, except that they may aggregate your Personally Identifiable Information with similar information from other Members in a manner that does not personally identify you.

RingPlus, cooperates with law enforcement inquiries, as well as other third parties, to enforce laws, such as protecting intellectual property rights and preventing fraud. We can (and you authorize us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, to respond to claims or legal process, to protect the property of RingPlus or the safety of its employees or others, to investigate fraud, intellectual property infringements, or other activity that is or may be illegal or expose us or you to liability.

It is possible that RingPlus or its partners could be acquired by or merged with another business entity. Should such a combination occur, you should expect that RingPlus or its partners will share some or all of your Personally Identifiable Information to continue to provide service. You will receive notice of such an event (to the extent that it occurs), and we will request that the new combined entity follow the practices disclosed in this Privacy Policy or notify you of any changes.

If you are a RingPlus Member, you may change the personal information you have elected to share with us. You also have choices in the types of communications you wish to receive from us. When you activated your device, your notification preferences were set to receive notices about special offers, events and promotions from RingPlus and special offers from our partners.

“Cookies” are small files placed on your hard drive; each website can send its own cookie to your browser if your browser preferences allow it. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is sent. When you turn on your mobile phone and use any of our location-based services, your device automatically communicates with our network and relays its current location. The accuracy of location services may be affected by circumstances beyond our control, including atmospheric, geographic or topographic conditions. We do not warrant or guarantee that location services will be available at any specific time or geographic location, or that service will be provided without interruption.

By using our location-based services, you consent to have us electronically collect, monitor and track your physical location and the location of your handset. We collect and disclose your location information only to provide you with the location-based services you have requested, or in emergency situations as prescribed by law. If you allow other users to use your handset, you are responsible for informing these users that their location information may be collected or disclosed. We will not provide your location information to third parties other than as prescribed by law without your consent.as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information that we or our partners collect from you. To the extent that you disclose your information to other parties, different rules may apply to their use or disclosure of your information. Monthly Recurring Taxes, Fees, and Surcharges

We want to be upfront and open with our Members about various taxes, fees, and surcharges that you may see on your wireless bill from us. We don't charge any fees or taxes that aren't imposed by the government or 3rd parties upon us. These taxes may include but are not limited to:

  • 911/E-911 Surcharge – a local or state-imposed surcharge to fund the 911/E-911 systems in your jurisdiction. Varies by location per month.
  • Federal Universal Service Charge – a federal-imposed surcharge on telecommunications services. Varies per month.
  • State Universal Service Charge - a state-imposed surcharge on telecommunications services (not applicable in all states.) Varies per state per month.
  • Telecommunications Tax - a city, county, locality, municipality, or state-imposed tax on telecommunications services, sometimes named differently than telecommunications tax (not applicable in all states.) Varies per state per month.
  • Sales Tax - a state-imposed tax on the sale of tangible property, such as wireless devices, not wireless service (not applicable in all states.) Varies per state.
  • International Termination - a variable rate fee depending on which country you call.

One-time and Non-recurring Fees

  • Restocking Fee - applies to all returns of working devices. Equivalent to 20% of the device purchase price.

Fees may change at any time without notice to comply with various local, state, and federal regulations.

DMCA Takedown Policy

Digital Millennium Copyright Act

If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

RingPlus' designated Copyright Agent for DMCA notices is Jerry Mowery. Any other legal feedback, comments, and other communications regarding notifications of claimed infringement should be directed to ethics@ringplus.net. You acknowledge that if you fail to comply with all of the requirements of this Section 5(D), your DMCA notice may not be valid.

Counter-Notice. If you believe that your Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your Content, you may send a counter-notice containing the following information to the Copyright Agent:

Your physical or electronic signature;

Identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled;

A statement that you have a good faith belief that the Content was removed or disabled as a result of mistake or a misidentification of the Content; andname, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in Los Angeles, California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, RingPlus may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed Content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Content provider, member or user, the removed Content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at RingPlus' sole discretion.
